NYSP: LeRay man accused of shaking, throwing his 4-month-old daughter

WATERTOWN, NY — On January 30, 2023, State Police in Watertown arrested Jason Osorio, age 23, town of LeRay, NY, for Reckless Assault of a Child*, a class “D” felony.

Osorio was charged following an investigation that determined on January 30th, at approximately 9:00 a.m., he was in the care and custody of his four-month-old daughter at their residence on Colonial Manor Road in the town of Leray when he became enraged with his child’s incessant crying and began maliciously shaking his child for approximately three minutes prior to throwing her into a Graco baby swing located in the living room of the residence, troopers said.

Shortly thereafter, Jason Osorio drove the victim to the Carthage Area Hospital where she was diagnosed with a subdural hematoma and subarachnoid hemorrhage as a result of his actions, troopers said.

The victim was transported to Upstate Golisano Children’s Hospital in Syracuse and was listed in stable condition.

Osorio was arraigned in Jefferson County CAP court and granted pre-trial release.

*NYS penal law §120.02 Reckless assault of a child:

  A person is guilty of reckless assault of a child when, being eighteen years of age or more, such person recklessly causes serious physical injury to the brain of a child less than five years old by shaking the child, or by slamming or throwing the child so as to impact the child’s head on a hard surface or object.
